Since May 25, 2018, Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or “GDPR”), has been in force and forms the legal framework for the processing of personal data.

This Privacy Policy (hereinafter referred to as the “Policy”) outlines how we collect and process your personal data when using and providing our products and services. This Policy explains how V-Protect Sp. z o.o., headquartered in Police, Tanowska 18, uses the personal data you provide, following prior notification or obtaining your consent where required by applicable law.

This Policy applies to customers of V-Protect Sp. z o.o. who use the available services. It also applies to all visitors to the website https://www.v-protect.com/, who may or may not be customers of V-Protect Sp. z o.o.

What Personal Data Do We Collect?

Due to the nature of our services and products, we may collect the following personal data, provided you have been notified or have given consent where applicable:

Purpose and Legal Basis for Processing Personal Data

The processing of your personal data is always voluntary, but necessary for the execution of the contract concluded with you in order to provide services by electronic means. Your data is required to:

  • Ensure the proper provision of services, including technical and complaint support, based on Article 6(1)(b) of the GDPR,

  • Provide marketing, promotional, and, if necessary, debt collection, legal, and enforcement purposes, based on Article 6(1)(f) of the GDPR,

  • Generate statistical data, based on Article 6(1)(f) of the GDPR,

  • Ensure accountability under GDPR, based on Article 6(1)(c) of the GDPR,

  • Fulfill tax and accounting obligations, based on Article 6(1)(c) of the GDPR.

Who May We Share Personal Data With?

In certain situations, we are entitled to share your personal data with other recipients if it is necessary to execute the contract concluded with you or to meet legal obligations. In such cases, we will transfer your personal data to three groups of recipients:

  • Authorized persons, such as our employees and collaborators who need access to the data to fulfill their job duties,
  • Data processors, to whom we delegate data processing tasks,
  • Other recipients, such as accounting offices, certification bodies, couriers, banks, insurers, legal firms, debt collection agencies, and public authorities.

Retention Period for Personal Data

We will retain your personal data for the duration of the contract and after its termination for purposes such as:

  • Pursuing claims related to contract execution,

  • Fulfilling legal obligations, especially tax and accounting requirements,

  • Preventing fraud and abuse,

  • Archiving and statistical purposes,

  • We will keep your data for a maximum of 10 years after the contract ends.

For accountability purposes, i.e., proving compliance with personal data processing regulations, we will retain data for the period during which V-Protect Sp. z o.o. is legally required to store data or documents containing them to prove legal compliance and allow for regulatory audits.

GDPR Rights

In accordance with the provisions of the GDPR and the Telecommunications Law, you have the right to:

  1. The right to express and withdraw consent for:
  2. the processing of your contact data, i.e., your email address and phone number, for receiving marketing communications via email, SMS, or phone calls;

  3. the processing of your contact data, i.e., your email address, for the purpose of receiving electronic invoices from V-Protect Sp. z o.o.;

  2. The right to rectify (correct) your personal data if the data we hold about you is inaccurate or incomplete;
  3. The right to delete your data if it is no longer necessary for the purposes for which it was collected, and V-Protect Sp. z o.o. has no basis for processing it, such as your consent or compliance with a legal obligation;
  4. The right to data portability of the data you provided to us, for example, if you would like to share it with another service provider;
  5. The right to restrict the processing of your data in the following cases (when submitting a request, please specify one of the following cases):
  6. if you have objections regarding the accuracy of your data;

  7. if you believe we should not process your data, but you do not want us to delete it;

  8. if such personal data is no longer needed by us, but you require it for the purpose of pursuing claims;
  9. The right to lodge a complaint regarding our processing of your personal data with the supervisory authority, which is the President of the Personal Data Protection Office.

Data Security

We regularly assess risks to ensure that personal data is processed securely, ensuring access is limited to authorized individuals only and within the necessary scope. We ensure that all data operations are logged and carried out by authorized staff or collaborators.
We take all necessary steps to ensure that third parties we collaborate with also provide appropriate security measures when processing personal data on our behalf.
